Warranty

Span Tech, LLC has carefully designed, manufactured and inspected all conveyors and/or components prior to delivery or shipment. In the unlikely event you find a defect in materials or workmanship within one (1) year after receipt of product, we will promptly repair or replace the product(s), in accordance with our Limited Warranty below. Our liability is limited to replacement of the product and this warranty does not apply to altered or misapplied products.

LIMITED WARRANTY

Span Tech, LLC, warrants to the initial purchaser that all Designer System products will be free from defects in material and workmanship for a period of one (1) year after receipt. Any claims made under this warranty are subject to inspection by Span Tech, LLC or by a certified representative upon receipt of defective product(s) returned to Span Tech, LLC, freight prepaid. Upon satisfactory proof-of-claim, Span Tech, LLC’s obligation under this warranty is limited to making suitable repairs or corrections, or at its option replacing the defective parts – free of charge – F.O.B. destination.

Important note: The above warranty applies only to items manufactured by Span Tech, LLC, and does not supersede or extend the original manufacturer’s warranty on any item. All items or components not manufactured by Span Tech, LLC, are warranted only to the extent and in the manner warranted by the manufacturer of such items or components. Please contact the applicable manufacturer for all warranty issues concerning items or components not manufactured by Span Tech, LLC. Outside manufacturers typically will not honor a warranty when mechanical modifications have been performed on their equipment.

The provisions of this warranty shall not apply to any Designer System product that has been subjected to misuse or improper installation and/or operation. The provisions of this warranty shall not apply to any Designer System product which has been altered or repaired without prior written consent of Span Tech, LLC. We do not warrant environmental effects which may cause undue wear to the system.

EXCLUSION OF OTHER WARRANTIES

Other than this limited warranty Span Tech, LLC, makes no other warranty for the equipment or the system in which it is used, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

EXCLUSION OF OTHER REMEDIES

The remedies set out above are the initial purchaser’s exclusive remedies for breach of this limited warranty. In no event shall initial purchaser be entitled to recover damages of any kind, whether direct, indirect, special, incidental, or consequential (including but not limited to damages due to delays in delivery, loss of production, loss of profit, loss of premiums, increased costs of operation, and loss of or damage to other equipment), resulting from the manufacture, sale, delivery or use of any product sold hereunder, in excess of the cost of replacement or repair as provided herein. Furthermore, Span Tech, LLC in no event shall assume liability or responsibility, either directly or by way of contribution or indemnity on any claim of any kind, whether in contract, tort or otherwise for any of the above referenced damages.
